First bail petition filed by the petitioner i.e. CRM-M-27815-2024 was withdrawn at that stage on 29.08.2024. Second bail petition i.e. CRM-M-68752025 was discussed in detail and lastly when this Court was not agreed, counsel did not press the same at that stage and, thus, was disposed of on 27.10.2025 (Annexure P-3). Hence, petitioner has filed instant third bail petition.

No. PB11-BF-4877, was occupied by total three accused, namely: (i) Sukhvir Singh @ Goldy (being driver) (petitioner herein), (ii) Harjinder Singh @ Budhu (sitting on co-driver seat), and (iii) Gurpreet Singh Goppi (sitting at the back seat of the said car). On searching the vehicle, from the dashboard of the car, 530 grams of heroin and currency notes, i.e., Rs.24,700/- of drug money were recovered.

Counsel for the petitioner argues that petitioner has no concern with the Innova car and has been falsely involved in the present case. Petitioner is inside jail since the period of last more a period of 02 years, 10 months and 22 days and trial is running at very low pace, Out of total 16 prosecution witnesses, only 07 witnesses have been examined and remaining 09 witness are yet to be examined. Thus, argues that petitioner cannot be detained in custody for indefinite period, untill, the charges are proved by deciding the fate of trial. Therefore, he prays for grant of bail to the petitioner.

Previously, when second bail petition was pending before this Court, a report was called for from the trial Court. Thereafter, it was informed that within 06 months trial is likely to be concluded and it was in that situation that the petitioner had to get the same disposed of by not pressing the bail petition.

Learned counsel for the petitioner contends that despite the assurance having been recorded in order dated 27.10.2025, neither the prosecution witnesses appeared before the Court nor the accused who are confined in jail were timely produced before the Court by the jail authorities.

The conduct of the prosecution agency need to be deprecated, which is under the direct control of the Department of Home in the State of Punjab. The facts and circumstances that the petitioner is inside jail for the last more than a period of 02 years, 10 months and 22 days and witnesses are still not coming forward or the accused are not produced by the jail authorities. The State itself has enabled the petitioner to press for the bail once again.

Accordingly, without commenting upon the merits of the case, and keeping in view the overall facts and circumstances, nature of allegations, period of incarceration already undergone, and the stage of trial, this Court deems it a fit case for grant of regular bail to the petitioner.

Consequently, prayer made in the present petition is allowed . Petitioner is ordered to be released on bail, subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case.

Needless to observe that the petitioner shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly.

A copy of the order be forwarded to the Home Secretary, Punjab and also to the ADGP, Jail Punjab to consider it as a notice that if repeatedly it continuous happening at the instance of State Agency (Agencies) in such like serious offences, enabling themselves to any of the accused to press hard for the bail, this Court would be compelled to call for the presence of any the aforementioned, for seeking explanation.
