Present petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking concession of regular bail in FIR No. 603 dated 14.11.2024, registered under Sections 305(a), 331(4), 3(5), 317(2), and 111(2) of the Bharatiya Nyaya Sanhita, 2023, at Police Station Sector 8, District Faridabad, Haryana.

2 . Prosecution case, in brief, is that an incident of theft took place during the intervening night of 13/14.11.2024 in the factory premises of the complainant, namely Rajesh Arora. Upon noticing the theft on the following morning at about 8:00 a.m., complainant got the present FIR registered. As per his statement, he had closed his factory and left for his residence at about 8:00 p.m. on 13.11.2024. When he returned the next morning, he found that the lock of the factory had been

broken and approximately two tonnes of iron strips along with one e- rickshaw were missing. He suspected that some unknown persons had committed the theft during the intervening night.

During the course of investigation, on 19.12.2024, police received a secret information pursuant to which accused Santu @ Santosh was apprehended from his residence. During interrogation, his disclosure statement was recorded, wherein he disclosed the involvement of the present petitioner, Kamal @ Khatul, along with certain other coaccused, in the commission of the offence.

Subsequently, after arrest of the petitioner, his disclosure statement was also recorded, wherein he disclosed that the stolen iron strips had been sold to a scrap dealer in Delhi. Acting upon the said disclosure, one scrap dealer, namely Illiyas Malik, was apprehended on 22.01.2025 from a scrap godown in South Delhi. The stolen iron strips were recovered and seized in accordance with law, and the recovery proceedings were duly videographed.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has no role whatsoever in the alleged occurrence.

This Court has considered the submissions made by learned counsel for the petitioner and has also perused the custody certificate produced by the learned State counsel. It is evident from paragraph 9 of the petition, as well as the custody certificate, that petitioner is a habitual offender. He has been involved in several criminal cases, and in five of

those cases he already stands convicted. It has further been brought to the notice of this Court that he has already undergone the sentence awarded in some of those cases. Apart from the present case, petitioner is also facing prosecution in other serious offences, including a case of murder.

Considering petitioner's criminal antecedents, nature of the allegations, and the fact that the recovery of the stolen property was effected pursuant to the disclosure statement made by the petitioner, this Court does not find any ground to extend the concession of regular bail at this stage. Accordingly, present petition is dismissed at this stage.
