The petitioner has filed the instant petition under Section 483 of the BNSS with a prayer to grant regular bail in case FIR No.67 dated 10.04.2025 registered under 21, 21-B, 29, 61 and 85 of NDPS at Police Station Sadar Ludhiana, District Ludhiana.

Learned counsel for the petitioner contends that as per case of the prosecution on 10.04.2025, Jaswant Singh @ Jimmy and Badal, both coaccused were arrested by the police for having 280 grams of heroin in their conscious possession. He further submits that the petitioner has been nominated as an accused in the present case only on the basis of disclosure statement suffered by co-accused. Apart from that there is no other evidence against him. Further, co-accused Gagandeep Singh @ Gaggu has been granted the concession of bail by a co-ordinate Bench of this Court vide order dated 20.03.2026.The petitioner was arrested in the present case on 10.04.2025 and is in custody for the last more than 01 year and 03 months.

He further submits that only one witness out of total 26 witnesses has been examined so far.

On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner on the ground that serious allegations have been levelled against the present petitioner and he does not deserve the concession of bail by this Court. However, learned State counsel submits that the petitioner is not involved in any other criminal case.

I have heard the learned counsel for the parties and perused the record with their assistance.

It is not in dispute that a similarly situated co-accused Gagandeep Singh @ Gaggu has already been granted the concession of bail by this Court on 20.03.2026. Moreover, the petitioner has been in custody for the last more than 01 years and 03 and trial is progressing at snail’s pace. Thus, further custody of the petitioner will not serve any meaningful purpose.

Without commenting on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate, concerned.
