2. In nutshell, the facts e m erging from record are that th e above mentioned FIR came into being at the instance of 'Suni l K umar @ Seena', hereinafter being referred to as 'complainant' only. It has been alleged by the c omplainant that on 10.12.202 5 at about 10.00 P.M. he along w i th 'Manoj' was standing outsid e his shops at Ratia Road near R avidas Dharamshala Tohana , w hen the co-accused namely 'Santokh', 'Satyawan', 'Anoop' , ' P arveen', 'Rajat', 'Rajesh @ Midda', 'Ankit', 'Ankush' an d ' A bhishek', all armed with ganda s i, sword, iron rods and woode n s t icks, came there. As per com p lainant, upon seeing them th e c o mplainant allegedly rushed t o the roof of house of 'Tarsem' ( p etitioner herein), while 'Manoj' ran away through the street. I t i s further alleged that all the a fo resaid persons armed with th e a f oresaid weapons, reached t h e roof top, where 'Tarsem' ( p etitioner) was accompanying t h em, and inflicted injuries upo n t h e head of complainant, left ar m , both legs and other parts o f t h e body with the help of stick s , gandasi and rods. It is als o alleged that petitioner No.1 had s natched the mobile phone of th e c o mplainant during the occurre n ce. Thereafter, it is alleged tha t t h e co-accused also intercepted ' Manoj' in the street and cause d i n juries on his person. As per complainant, the medico-lega l r e ports shows that the complainant and 'Manoj' have sustaine d m ultiple injuries caused by blunt weapons.
