P resent petition has been filed under Section 483 of the BNSS, seeking regular bail in case FIR No.264 dated 14.07.2023, under Sections 307, 34 of IPC and Sections 25, 27 54 of Arms Act, registered at Police Station Sohana, District SAS Nagar, Mohali.

The FIR got registered by complainant-Suraj Kumar and incident in the present case happened on 14.07.2023 at about 01:30 AM, outside the house of complainant.

3 . As per allegations in the FIR, the accused persons namely Lokesh Kumar, Maya, Rakhi and Rahul gathered in front of the house of the complainant and then called him outside. Petitioner-Ankit @ Maya fired total four shots with the pistol he was armed. First fire shot hit on the inner side of knee of right leg of the complainant and thereafter, he fell down.

second gunshot also hit on left side of the complainant’s brother. The earlier two petitions i.e. CRM-M-4684-2024 and CRM-M-28434-2025, Annexure P-4 and P-8, filed by the petitioner, were withdrawn on 16.10.2024 and 27.05.2025, respectively. Counsel argues that the prime two witnesses i.e. injured-complainant Suraj and eye-witness Chandan though appeared in the witness-box, have resiled from the version of prosecution. Counsel also submits that the trial is not proceeding at required pace because as now out of total witnesses, only two have been examined.

Considering the serious allegations against the petitioner with firing minimum four shots with pistol in his arm and the fact that he is involved in other 17 criminal cases, I do not fine it a fit case for releasing him on bail. Moreover, the aspect of recovery of weapon and the bullets fired from it, tallying with the recovered bullet is yet to be a question, besides the final stage by the trial Court.

In view of the fact that witnesses have turned hostile and however, the allegations are very serious, a direction is also issued to the trial Court to speed up its proceedings, not to afford the ground to the accused for making prayer for release on bail, in view of the delayed trial. 8 . The present petition is hereby dismissed.
