As per the allegations, 255 grams of alprazolam was recovered from the possession of the petitioner, resulting into the registration of the impugned FIR No.83 dated 26.04.2019.

Learned DAG, Punjab appearing on advance notice shares his information that already the petitioner was involved in three cases under the NDPS Act i.e. FIR No.249 dated 07.11.2019 under Sections 21, 61 and 85 of NDPS Act, Police Station Shahkot, FIR No.35 dated 20.03.2018 under Sections 22, 61, 85 of NDPS Act, Police Station Sadar Kapurthala and FIR No.110 dated 26.09.2015 under Sections 22, 61 and 85 of NDPS Act, Police Station Lohian and in one case i.e. FIR No.110 dated 26.09.2015, the petitioner was acquitted by the trial Court on 18.08.2016. that after registration of the present case, petitioner was granted interim bail on 04.07.2019, on account of non-availability of the FSL report. However, when report was received and petitioner failed in appearing before the Court, the concessional relief of grant of bail was cancelled on 09.03.2021 and therefore, petitioner was declared proclaimed offender on 19.03.2025.

3 . Further informed that petitioner has prolonged a part being indulged in four other cases and he has misused the concession for a period of about four years i.e. from 09.03.2021 to 14.05.2025, when petitioner surrendered in the Court.

4 . Faced with the situation, counsel for the petitioner seeks withdrawal of the instant petition.

5 . Dismissed as withdrawn, at this stage.
