This petition has been filed under section 483 B.N.S.S. for grant of regular bail in case FIR No. 120 dated 29.08.2024 under Sections 103(1), 3(5) of BNS, 2023 under Sections 103 (1), 3(5) of BNS, 2023 registered at Police Station- Dakha, District Ludhiana, Rural.

The case of the prosecution, in brief, is that the present FIR was registered on the statement of Vikram Saggar, who alleged that his father, Ravinder Singh Pal, had gone missing on 26.08.2024. On 29.08.2024, he identified the dead body of his father at the Civil Hospital, Ludhiana. During the course of inquiry, his sister, Kirandeep Kaur, disclosed that she had come into contact with co-accused Ranjit Singh Kahlon @ Ranjit Bath through TikTok. And in the month of March 2024, Ranjit Bath allegedly threatened to kill her family members if she did not take divorce from her husband. She

further alleged that on 25.08.2024, Ranjit Bath, along with his nephew Baljinder Singh @ Bully @ Gully (the present petitioner), visited her father and, in furtherance of their common intention, murdered him. It was also alleged that Ranjit Bath sent her a WhatsApp message admitting his involvement in the murder and informing her that the dead body had been thrown near the roadside bushes. During further investigation, the complainant made a supplementary statement reiterating the aforesaid allegations and specifically stating that the petitioner, along with the co-accused, had taken the deceased in a Skoda car bearing registration No. PB-08-BN-0021 and killed him by strangulation. The prosecution further alleges that the petitioner subsequently surrendered before the police through the Sarpanch of Village Bath and got the aforesaid Skoda car recovered pursuant to his disclosure statement.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. He further submits that the entire prosecution story is based on hearsay evidence, as the FIR was registered on the basis of the version allegedly conveyed by one Kirandeep Kaur to the complainant. It is further contended that the petitioner has been nominated solely on the basis of an extra-judicial confession allegedly made before a witness, namely, Kulwinder Kumar, Sarpanch. However, even in the said extra-judicial confession, there is no allegation or material to indicate that the petitioner was privy to or had participated in the alleged crime. It is further

submitted that the petitioner is in custody since 30.08.2024 and prays for grant of regular bail.

Mr. Subhash Godara, Addl. Advocate General, Punjab. accepts notice on behalf of the respondent–State and has vehemently opposed the prayer for grant of regular bail on the ground that allegations against the petitioner are grave and serious. He has filed the custody certificate of the petitioner in Court today, which is taken on record. As per the custody certificate, the petitioner is in custody for the last 1 year 10 months and 4 days and is not involved in any other case.

I have heard the submissions made by the parties and gone through the record.

After hearing the rival contentions and considering the fact that the petitioner is in custody for the last 1 year 10 months and 4 days, not involved in any other case coupled with the fact that the trial is likely to take considerable time, this Court is of the view that no useful purpose would be served by further incarceration of the petitioner. Accordingly, the petitioner is granted the concession of regular bail during the pendency of the trial.

Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
