Th i s is the first petition under Section 483 of the Bharatiya Na g rik Suraksha Sanhi t a, 2023 for grant of regular ba i l to the petitioner in case FIR N o. 27 dated 06.03. 2 025, registered under Section 2 1 (b), 29/61/85 of Narcotic D r ugs and Psychotrop i c Substances Act, 1985 and Se c tion 25/54/59 of Arms Act and 27A NDPS Act e nhanced vide rapat No.23, dat e d 08.03.2025, registered at Po l ice Station Sarhali, District Tarn Taran.

Th e case of the prosecution, in b r ief, is that on 06.03.2025, an A SI along with othe r police officials was on patrol d uty in connection with checkin g of suspicious per s ons and searching for bad elements. The police party w as proceeding fro m CIA Tarn Taran towards Sh e ron, Naushehra Pannuan That h ian Mahanta. Whe n the police party reached in f r ont of the office of PSPCL, t h ree suspicious pers o ns were allegedly seen standi n g there. Upon noticing the po l ice party, they alle g edly attempted to turn back. O ut of them, one person alleg e dly took out a poly t hene packet from the right po c ket of his pant and threw it on the

side of the kach h a road. On suspicion, the polic e apprehended them and asked t h eir names. The co- a ccused Lalit Sharma disclosed t hat the person who had thrown the polythene pack e t was Jashanpreet Singh @ G i ani (present petitioner). The o t her two persons dis c losed their names as Jobanjit S ingh @ Joban and Manpreet Si n gh @ Manna. The s aid polythene packet was alleg e dly picked up from the ground a nd the petitioner a l legedly stated that it containe d heroin. On search, 200 gram s of heroin, a .30 b o re loaded pistol, and five live cartridges were allegedly recove r ed. On this basis, t h e present FIR was registered.

D u ring investigation, on the di s closure statement of co-acc u sed Jobanjit Singh, Navalpreet Singh and Ramaneet Singh were nominated as coaccused. A Hy u ndai Aura car and ₹9,00,000/allegedly constituting drug mo n ey were recovered from them. Further, on the d i sclosure statements of Navalp r eet Singh @ Gold y and Ramneet Singh @ Raman, Lalit Sharma was also nomin a ted and ₹20,000/- a l ong with a money counting ma c hine was allegedly recovered f r om his possession. 4. Le a rned counsel for the petitioner s ubmits that the petitioner has been falsely implicat e d in the present case. It is cont e nded that the alleged recovery has been planted an d the petitioner was not in cons c ious possession of the contraba n d. It is further sub m itted that the quantity allegedl y recovered is 200 grams of her o in, which falls wit h in the intermediate quantity, a n d therefore the rigours of Sec t ion 37 of the NDPS Act are not attracted. Learn e d counsel further submits that the petitioner has b e en in custody since 06.03.202 5 , the investigation is complete, a nd the challan has already been presented before t h e trial Court. that co-accuse d , namely, Lalit Sharma @ L alit, Manpreet Singh @ Ma n na, Navalpreet Sin g h @ Goldi, Ramneet Singh @ Raman and Taufiq Khan @ B a blu have already been granted the concession of re g ular bail by a co-ordinate Benc h of this Court. Thu s , it is prayed that the petitione r may be granted the concessio n of regular bail.

Pe r contra, learned State counse l has filed the custody certificate, which is taken on record. Learned State coun s el opposes the prayer for gran t of regular bail to t he petitioner and submits that t he allegations levelled against the petitioner are s e rious in nature as they relate to offences under the Narcotic D ru gs and Psychotro p ic Substances Act, 1985 as well as the Arms Act. It is fur t her contended that t he petitioner was apprehended at the spot and from his posses s ion 200 grams of h e roin, along with a .30 bore lo a ded pistol and five live cartrid g es, were allegedly recovered. Learned State cou n sel submits that the recover y of narcotic substa n ce coupled with a firearm indi c ates the gravity of the offence a nd, therefore, the p e titioner does not deserve the c o ncession of bail. However, lear n ed State counsel d oes not dispute that the qua n tity allegedly recovered from the petitioner falls within the intermediate quanti t y. It is also not disputed that the petitioner has b een in custody since 06.03.20 2 5, the investigation in the pre s ent case stands co m pleted and the challan has a lready been presented before the learned trial C o urt. It is also fairly conceded t hat the trial is likely to take s o me time to conclud e .

intermediate q u antity under the provisions of the NDPS Act. Consequently, the rigours of Secti o n 37 of the NDPS Act would n o t strictly apply in the present case. It is also not in dispute that the investigation i n the present case stands compl e ted and the challa n has already been presented b efore the learned trial Court. T he conclusion of t r ial is likely to take a consider a ble period of time, particularl y in view of the n u mber of accused persons inv o lved and the witnesses yet to be examined.

Wi t hout expressing any opinion on the merits of the case, a nd considering the period of custody, the nature o f allegations and the stage of t r ial, this Court is of t he view that further incarcerati o n of the petitioner would not s e rve any useful purp o se.

Co n sequently, the present petitio n is allowed. Petitioner Jashanp r eet Singh @ Giani is ordered to be released on re g ular bail, subject to his furnis h ing bail bonds and surety bonds to the satisfacti o n of the learned trial Court/ D uty Magistrate con c erned.
