Th i s is the first petition under S e ction 483 of the BNSS, 2023 for grant of regula r bail to the petitioner in case FIR No. 0047 dated 13.05.2 0 24, registered unde r Sections 302 and 34 of the IP C and Sections 25/54/59 of the A r ms Act at Police St a tion Sangat, District Bathinda.

Br i efly stated, as per the prosec u tion version, the present FIR w as registered on t he statement of complainant Saroj Rani, who alleged that on 13.05.2024 at a bout 3:30 p.m., she along w i th her husband and children w as present at her h o use when Lakhwinder Singh @ Lakhi and Jaskaran Singh @ M ika and Jaskaran Singh of village Jassi Baghwal i came there. Shortly thereafte r , a white Swift c a r bearing registration No. P B -03BL-3407 arrived, from w h ich Gobind Singh, Pargat Singh @ Ubha and Kul w inder Singh @ Teeta, along w ith Baldev Singh, a llegedly alighted armed with w eapons. It is alleged that Go b ind Singh abused h e r husband and, when the main g ate was bolted, fired a shot thro u gh a small openin g towards her husband, which h it him in the chest, causing hi m to

fall on the gro u nd. The accused thereafter fl e d from the spot. The injured w as taken towards Civil Hospital, but he succu m bed to his injuries near Sa n gat Crossing, and p o st-mortem was conducted at C i vil Hospital, Bathinda. The mo t ive attributed in th e FIR is previous enmity betw e en Gobind Singh and Lakhwi n der Singh, who alle g edly had friendly relations wit h the deceased, on account of w h ich the murder was committed.

Le a rned counsel for the petition e r contends that out of the c i ted witnesses, the t hree material prosecution witn e sses have already been exami n ed and they have n ot supported the case of the p r osecution and have been decl a red hostile. It is f u rther submitted that nothing i ncriminating has come on re c ord against the peti t ioner from their testimonies an d the remaining evidence, if an y , is yet to be appre c iated during the course of tria l to determine whether the sam e is sufficient to a f fix guilt upon the petitioner. L earned counsel submits that the petitioner has b e en in custody since 14.05.202 5 and the trial is likely to take t i me to conclude. It is also argued that co-accused K ulwinder Singh has already been released on bai l on the ground that the materia l witnesses have turned hostile a nd, therefore, the p e titioner also deserves to be rele a sed on bail on the same ground . 4. Le a rned State counsel has oppose d the prayer for regular bail on the ground that se r ious allegations of commissi o n of murder have been leve l led against the pet i tioner, who, along with the ot h er co-accused, is alleged to have committed the murder of the deceased. It is submitted that the offence u n der Section 302 IP C is grave and heinous in natu r e and merely because the mat e rial witnesses have turned hostile at this stage wo u ld not entitle the petitioner to the concession of r e gular bail. It is further argued t hat the prosecution case canno t be

discarded solel y on account of hostility of cert a in witnesses and the matter is s till to be adjudicated upon during the course of tria l .

Af t er considering the rival submi s sions and perusing the record, t his Court finds that the material witnesses examine d so far have not supported the c ase of the prosecut i on and have been declared ho s tile. Co-accused Kulwinder Si n gh alias Teeta has a lso been released on bail by a co-ordinate Bench of this Cour t on the ground tha t the witnesses have turned hostile. It is further noticed that the specific attribution of the gunshot injury is no t against the present petitioner. T he petitioner has b e en in custody since 14.05.202 5 and the trial is likely to take t i me to conclude.

Wi t hout commenting on the meri t s of the case, this Court is of the considered vie w that no useful purpose would b e served by keeping the petiti o ner in further custo d y.

Ac c ordingly, the present regular b ail application is allowed and the petitioner is or d ered to be released on bail sub j ect to furnishing adequate bail and surety bonds to the satisfaction of the trial Cour t concerned. 8. However, it is clarified that any o b servation made herein is only for the purpose of deciding the present petition and shall not be construed as an expression on t h e merits of the case at trial. 9.
