Instant petition has been filed u/s 528 of BNSS, 2023 (erstwhile Section 482 of Cr.P.C.), for, inter alia, seeking directions in respect of FIR No.187, dated 12.10.2025 (P-2), lodged under Sections 61(2), 333, 190, 191(3), 118(1), 115(2) of BNS, 2023, registered at P.S. Division No.2, District Pathankot, and related FIR’s, which are mentioned in synopsis for transferring the investigation by setting up a High Level SIT (Special Investigation Team) for investigation.

I. Present application has been filed under Section 528 of the BNSS, 2023 read with Section 482 Cr.P.C., on behalf of the applicants, for impleading them as party/respondents in the main petition, i.e., CRM-M4344-2026.

II. Proceedings in the main petition are with regard to issuance of directions in respect of FIR No.187, dated 12.10.2025, under Sections 61(2), 333, 190, 191(3), 118(1) and 115(2) of BNS, 2023, registered at Police Station Division No.2, District Pathankot, including transfer of investigation by constituting a High Level SIT.

Applicants herein, namely, (i) Davinder Kumar son of Sham Lal, and (ii) Rakesh Kumar Ghai son of late Sh. Yashpal, have nothing to do with the proceedings arising out of the aforesaid FIR, as neither are they the complainant/victims nor do they have any concern

with the case in hand. Despite that, the present application has been moved seeking their impleadment as party/respondents in the main petition. III. After hearing learned counsel for the applicants and upon perusal of the contents of the application, this Court does not find any

substantial reason to entertain the present application, as the applicants have no locus standi to seek their impleadment in the main petition. Moreover, all the necessary parties have already been arrayed as respondents in the main petition.

Consequently, present application stands dismissed .

Learned State counsel informs that qua the FIR in question, i.e., FIR No.187, dated 12.10.2025, cancellation report has already been submitted in the Court.

Today, at the very outset, learned State counsel informs that after completion of investigation in FIR No.187, dated 12.10.2025 (supra), cancellation report has already been presented before the Court concerned.

Since there is no representation on behalf of the petitioner and cancellation report has already been presented before the Court concerned, instant petition has been rendered infructuous.

Moreover, upon presentation of the cancellation report, if any remedy is available to the petitioner, same may be availed of in accordance with law.
