The instant 2^nd petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioner, during the pendency of trial, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:-

On 22.01.2026, the first petition filed by the petitioner seeking

grant of regular bail was withdrawn to enable him to avail appropriate remedy before the concerned trial Court.

Petitioner is inside jail since 23.09.2025, and the offences alleged are triable by the learned Magistrate. Allegations are of playing fraud with the bank, as petitioner had taken a loan of Rs.26 lakhs, the outstanding amount of which on account of non-payment of the installments

has increased more than Rs.58 lakhs. Another allegation is that petitioner after mortgaging the land with the bank in lieu of loan amount has sold out the land to some other person.

Considering the aforesaid facts and circumstances in their entirety, particularly the allegation that public money has been defrauded by the non-payment of the loan amount, the present petition is disposed of with the observation that it shall remain open to the petitioner to file a fresh petition for regular bail after undergoing one year of custody.
