Learned counsel for the petitioners contends that th e petitioners have been falsely im p licated in the present case. H e argued that in fact, it is a case of version and cross-versio n w herein one Hari Singh (decea s ed) along with petitioners an d t h eir other relatives were mer c ilessly attacked as a result o f w hich Hari Singh lost his life. H e has further argued that th e petitioners are in fact the com p lainants in the main FIR. H e f u rther submits that the opposite p arty are influential people an d are using every possible way t o pressurize the petitioners t o c o mpromise the matter. Howev e r, since the petitioners did no t bow down, the opposite party g o t registered the present cross - v e rsion GD. He further submit s that initially GD No.45 wa s r e gistered by the officer conce r ned with the remarks that G D s e ems suspicious and requires v e rification, however, another G D bearing No.46 was registered a gainst the petitioners thereb y c a sting doubt on the prosecution story.

He has further argued tha t even if the contents of the DD R are taken to be true, only role at t ributed to the petitioners is tha t t h e petitioner No.1 was armed w ith a datar and petitioner No. 2 being part of unlawful assembly had pushed the family member s o f one Rashpal Singh. Learned c ounsel further submits that th e petitioners are ready and willi n g to join investigation as an d w hen called upon to do so by the investigating agency.

On the other hand, learn e d State counsel while referrin g t o the status report, has opp o sed the prayer for grant o f anticipatory bail, by submittin g that the allegations levelle d a g ainst the petitioners are serio u s in nature. He argued that th e

petitioners were specifically na m ed in the DDR and they hav e actively participated in the crime .

In the meantime, the p e titioners are directed to joi n i n vestigation within a week from today and would appear as an d w hen required by the Investiga t ing Officer and cooperate wit h t h e Investigating Agency. In th e event of arrest, they shall b e admitted to interim bail on furni s hing of bail/surety bonds to th e s a tisfaction of Arresting/Investi g ating Officer. The petitioner s s h all also abide by the conditi o ns as envisaged under Sectio n 482(2) of BNSS, 2023.”

L earned counsel for the petitioners submits that in compliance o f the order dat e d 05.05.2026 passed by this C o urt, the petitioners have joine d the investigation.

L earned counsel for the State, o n instructions from ASI Joginde r Singh, has su b mitted that the petitioners have joined the investigation and ar e no longer req u ired for further investigation.

I n view of the statement made by learned State counsel, th e interim order dated 05.05.2026 passed by th i s Court, is made absolute. Th e petitioners sh a ll continue to join investigati o n, as and when called by th e Investigating O fficer and shall also abide by t he conditions as provided unde r Section 482(2 ) of the BNSS.
