Criminal COMI/20/2021 titled “Laxman Dass v/s Subash Chand” pending in the complaint court of ACJM, Jind No.

Seeking transfer of complaint captioned above, the petitioner has come up before this Court under Section 447 of BNSS, 2023.

Counsel for the petitioner submits that the petitioner is suffering from severe illness due to his advanced stage of life and presently living in Panchkula due to his treatment and it is difficult for the petitioner to move to Jind to attend the court proceedings, as such prayed for transfer of complaint.

I have gone through the record and heard counsel for the petitioner at length.

Counsel for the petitioner submits that the petitioner would be contended and satisfied if he is permitted to appear through video conferencing and shall not claim any prejudice in this regard.

Given above, the present petition is partly allowed. Petitioner is permitted to appear through video conferencing on the next date of hearing before the trial Court and JYOTI SHARMA 2026.01.16 16:55 thereafter, whenever petitioner moves an application to appear through video I attest to the accuracy and authenticity of this order/judgment High Court, Sector 1, Chandigarh

conferencing or file an application for exemption from personal appearance, in that case, the trial Court is requested to consider the same sympathetically. It is further clarified that if in the opinion of the trial Court, on any date, physical appearance of the petitioner is required, he would appear in person.
