Shekhawat, J.), CRM-M-10759-2026, decided 03.07.2026 — Petition under Section 582 of BNSS for quashing of DDR No.30 dated 08.06.2016 (Sections 323, 324, 506, 34, 148 and 149 IPC) lodged in FIR No.91 dated 08.06.2016 (Sections 324, 323, 148 and 149 IPC; Section 326 IPC added later on), registered at Police Station Dharamkot, and all subsequent proceedings arising therefrom, on the basis of a compromise. Pursuant to a Co-ordinate Bench order dated 04.05.2026, the parties appeared before the Judicial Magistrate First Class, Moga and got their statements recorded; the report dated 16.06.2026 showed the Court below's satisfaction that the compromise was genuine, voluntary and without any coercion or undue influence. The instant petition has been filed under Section 582 of BNSS for quashing of DDR No.30 dated 08.06.2016, under Sections 323, 324, 506, 34, 148 and 149 IPC in FIR No.91 dated 08.06.2016, under Sections 324, 323, 148 and 149 IPC and Section 326 IPC (added later on), registered at Police Station Dharamkot and all subsequent proceedings arising therefrom on the basis of the compromise.

Vide order dated 04.05.2026, a Co-ordinate Bench of this Court had directed the parties to appear before the Illaqa Magistrate/trial Magistrate for getting their statements recorded with respect to the aforesaid compromise.

Pursuant to aforesaid order, the parties have appeared before the Judicial Magistrate First Class, Moga and got their statements recorded. Report dated 16.06.2026 has been received whereby after recording the statements of the parties, the Court below has shown its satisfaction that the compromise is genuine, voluntary and without any coercion or undue influence.

In the light of the satisfaction shown by the Court below and considering the offence for which the accused have been charged are not of serious nature, together with the fact that compromise will go a long way in ironing out the differences for betterment of future life of the parties and also in view of the law laid down in Gian Singh
