The present revision petition has been filed under Article 227 of the Constitution of India seeking a direction to the learned trial Court, Garhshankar, to decide the Civil Suit bearing No. CS-338-2021 dated 12.08.2021 titled as ‘Paramjit Kaur Layal Vs. Jagjit Singh Layal and others’ within a time-bound manner.

The brief facts of the case are that the present petitioner–Paramjit Kaur Layal filed a civil suit before the learned trial Court seeking a declaration to the effect that she is owner in joint possession of the suit property, as detailed in the headnote of the plaint. Notice of the said suit was issued to the respondents, wherein respondents No.11 to 37 failed to appear before the learned trial Court and were accordingly proceeded against exparte . The remaining respondents appeared and filed their written statements. As per the order dated 29.04.2023, 11 issues were framed, including the relief issue, and thereafter the case was fixed for respondents/defendants’ evidence, as the onus to prove most of the issues was upon the respondents/defendants. trial Court, the respondents have availed as many as 50 opportunities to lead their evidence; however, till date, they have failed to conclude the same.

Learned counsel for the petitioner contends that the learned trial Court is proceeding with the case at a snail’s pace. He further submits that despite availing as many as 50 opportunities to lead their evidence, the respondents have failed to conclude the same till date. Accordingly, prayer has been made for issuance of directions to the learned Civil Judge (Jr. Divn.), Garhshankar, to decide the case expeditiously within a time-bound manner.

Considering the limited nature of relief sought, issuance of notice to the respondents is dispensed with, as the same would only result in further delay in the proceedings.

I have heard learned counsel for the petitioner and have perused the paper book.

Keeping in view the submissions made by learned counsel for the petitioner and without commenting upon the merits of the case, the present revision petition is disposed of with a direction to the learned Civil Judge (Junior Division), Garhshankar, to conclude the entire evidence of the respondents within a period of two months from today by granting short adjournments. Thereafter, effective opportunity shall also be afforded to the petitioner to lead her entire evidence in accordance with law.
