Learned counsel for the pet i tioner submits that contempt proceedi n gs be initiated against the resp o ndent for not complying the order dat e d 27.7.2023 (Annexure P-1) p a ssed by a co-ordinate Bench of this C o urt in CWP-19214-2017 titled as “Gurpreet Kaur vs. State of Punja b and others”, whereby the re s pondents were directed “ to consider the case of the petitioner for a pp ointment on compassionate ground fo rthwith and the appointment shall relate back from the period, t h e petitioner had submitted app l ication for the post of Clerk i.e. 22.2. 2 002. However, the benefit for the intervening period shall be purel y notional. Compliance be m a de within a period of three months f r om today” .

Learned counsel for the re s pondents-State submits that necessar y compliance has been made w h ile passing Speaking Orders dated 02.1.2026 (Annexures R-1/T to R- 3 /T). Learned counsel for the State ref e rs to paras 2 and 3 of the Spe a king Order dated 02.1.2026 (Annexu r e R-1/T), which reads as follow s :-

In compliance w ith the orders of the Hon'ble Punjab and Haryana High Court, vide this office order No.: 331-4 0 /Confidential SB-4 dated 10.01.2024 the petiti o ner Mrs. Gurpreet Kaur has been offered an appoi n tment as Clerk in the Police Department, Punjab, in the pay scale of *31205160/- (initial pay ₹3220/-) effective from 22.02.2002 (the bene f it for the intervening period shall be purely notio n al) and posted as a Clerk in the Intelligence Win g , Punjab, SAS Nagar. This female employee sub m itted her joining report for duty at the Intell ig ence Wing, Punjab, on 11.01.2024 for-noon. She has also passed the Punjabi type test on 2 0.02.2025 as per the service conditions mentioned i n the appointment letter. 3. Mrs. Gurpreet Kaur, Clerk (CNR Number: 1265-A), is placed a s a Junior Assistant at par with her to a Junior employee w.e.f. 30.03.2012 (Financial Benefits f r om the date of passing the Typing Test dated 20.02.2025) in the pay scale of 10300-34800 + 3600 Grade Pay, subject the following conditions: -

Mrs. Gurpree t Kaur, Junior Assistant (Seniority No. 1265- A ) is promoted to the post of Senior Assistant at the equivalent of Junior employee w.e.f. 17. 0 5.2021 (financial benefits w.e.f. 20.02.2025 aft e r passing the typing test) under Punjab Poli c e Clerical Service (State Service Class-3) R ules-1960, Punjab Civil Services (General and Common Services Conditions) (Second A mendment) Rules-2015, and Punjab Civil Services (Revised Pay) Rules 2021 at the Matrix Level-11 (P ay Scale 38,500-1,22,700/INR) as shown in the S chedule.

4. This promotion is granted under the following conditions:-

1. This pro m otion will be effective from the date of assu m ing the duties of the post. 2. The pro m otion may be reconsidered as per the poli c y determined by the Punjab Government in a ccordance with the decision dated 19.10.20 0 6 of the Hon'ble Supreme Court regardi n g the 85th Constitutional Amendment.

3. If there i s any change in the seniority list based on any decision of the Court or due to administrative requirements, the promotion may be reconsidered.

4. If the va c ancy in the cadre of Senior Assistant decr e ases for any reason, the employee will b e reverted to the lower post without any not i ce. 5. The pro m otion of this employee will be subject to t h e final decision in SLP No: 10015/2023 pe n ding in the Hon'ble Supreme Court of India. ”

Learned counsel for the pet i tioner submits that since the Writ Co u rt order dated 27.7.2023 (Anne x ure P-1) has been complied with whi l e passing the Speaking Orders dated 02.1.2026 (Annexures R-1/T to R-3/T) by the respondent-authority, nothing survives in the present c o ntempt petition and the same m ay be disposed of.

In view of the above note d facts and the submissions made by learned counsel for the petit i oner, the present contempt petition i s disposed of .
