Present contempt petition ha s been filed alleging violation of order d ated 16.12.2008 (Annexure P-1 ) passed by a Division Bench of this C o urt in CWP-17495-2007 titled a s <Citizens for Public Causes (Regd.) vs. The State of Punjab and othe r s=, whereby the writ petition was disp o sed of with the following observ a tions :-

<&.Mr.Sareen learne d senior counsel appearing for the petitioner submits t hat in the light of the decision now taken by the Stat e Govenrment, nothing further survives for considera t ion in this petition except that a direction ought to b e issued to the government to expedite the process o f construction of the road and to complete the same w ithin a specific time frame.

Mr.Amol Rattan Singh, counsel appearing for respondents No.1 and 4. however, submits that the process of acquisition of the land required for the second link between F and G in the site plan has not yet started as the authority is still in the process of preparing a site plan f or the same, no time frame can be truly realistic a t this stage.

Learned couns e l appearing for some of interveners, who hap p en to be owners of the land between missing link N o.1 marked D to E in the site plan submitted that t heir houses have yet to be demolished in case the said link was to be constructed. It is n o t, however, disputed that challenge to the acqui s ition proceedings in relation to the said land has a lready been repelled by the Courts and all that r e mains to be done is to carry out the construction w o rk in that area.

In the circumsta n ces, therefore, nothing really survives for our consi d eration in these proceedings. The writ petition is ac c ordingly disposed off with the observations that the a u thorities concerned would be well advised to expedi t e the process of construction of the road so that substantial expenditure already incurred on construct i on of the two stretches that have already been constructed does not go infructuous. All pen d ing applications shall also stand disposed off in light of the above order. No costs.=

At the outset, learned Se n ior Counsel appearing for responde n ts No.1, 3 and 4, on instructio n s, submits that in substantial complian c e of the aforesaid Writ Court order dated 16.12.2008, the construct i on work stands completed exce p t for the missing second link

from Poi n t 8F9 to 8G9. It is further u n dertaken that the remaining construct i on shall be completed by Octobe r , 2026.

Learned counsel for the peti t ioner submits that in view of the unde r taking given on behalf of res p ondents No.1, 3 and 4, the present c o ntempt petition may be disposed of.

Keeping in view the peculiar f acts and circumstances of the case, an d the undertaking given by l earned Senior Counsel for responde n ts No.1, 3 and 4, time is grante d to complete the construction of the re m aining link positively on or befo r e December, 2026.

In view of the above underta k ing and the statements made by learn e d counsel for the parties, the present contempt petition is disposed of with the aforesaid direction.

However, it is made clear th a t in the event the needful, as undertak e n, is not completed within the s t ipulated period, the petitioner shall be a t liberty to seek revival of the present contempt petition in accordan c e with law.

Rule stands discharged.

Pending application(s), if any , shall also stand disposed of.
