By way of filing the presen t appeal the appellant-claimant seeks enh a ncement of compensation amo u nt of ₹22,10,000/- awarded to her vide i mpugned Award dated 20.0 4 .2021 by the learned Motor Accident C laims Tribunal, Panipat, in a claim petition bearing RBT No. 86 of 2020 dated 21.10.2017/28.02.2020 f i led under Sections 140 and 166 of the Mot o r Vehicles Act, 1988.

The matter pertains to year 2 0 22 and notice in main appeal is yet to be i s sued. Perusal of the record rev e als that along with the present appeal an a pplication bearing No. CM-34 5 3-CII-2022, under Section 5 of the Limita t ion Act for condonation of dela y of 176 days in filing the main appeal has also been filed. On the last dat e of hearing i.e. 12.08.2025, the appellant h ad gone un-represented and fol l owing order was passed by this Court:-:-

“The present appeal is of the year 2022 and there has been a delay of 176 days in f iling the appeal also. Notice o f motion has not been issued so far. Since there is no re p resentation on behalf of the applicant-appellant, in the i n terest of justice, adjourned to 23.2.2026.”

Today again, the appellant h a d gone un-represented, despite the case h a ving been called twice.

A bare reading of the above facts shows that the appellant has exhib i ted an utterly casual attitude in her pursuit of the present litigation. I t is to be appreciated that ve r y valuable public time of the Court has b een expended in affording opp o rtunities to the appellant in the interest of j ustice. On the other hand, the a ppellant has adopted an utterly casual and careless approach. It is clear t h at neither the appellant nor her counsel is seriously interested in pursuin g the present matter. Thus, this Court is l e ft with no other option excep t to dismiss the same for nonprosecutio n .
