This is an applica�on under Sec�on 5 of the Limita�on Act to condone the delay of 85 days in filing the appeal.

For the reasons as men�oned in the applica�on, supported by an affidavit of Shri Dampreet Walia, General Manager (Legal) of PUNSUP - appellant, delay of 85 days in filing the appeal is hereby condoned.

The suit for recovery of `2,05,96,112/- filed by plain�ffs (appellants herein) was dismissed by the trial Court on 23.02.2018 and the appeal filed by the plain�ffs-appellants was dismissed by the First Appellate Court on 21.12.2019, thus affirming the findings of the Courts below.

Assailing the concurrent findings, it is contended by learned counsel for the appellants that the Courts below have failed to appreciate the record properly.

One of the main reason for non-sui�ng the plain�ffs-appellants by dismissing their suit is that the suit was barred by limita�on.

¶21

A�er perusing the paper book, it is revealed that plain�ff sought recovery from the defendants for a liability which had allegedly occurred in 1999-2000. The suit for recovery was filed in July, 2014, i.e. a�er more than 14 years.

¶22

In the aforesaid facts and circumstances, the Courts below did not commit any error in coming to the conclusion that the suit was barred by limita�on. As such, there is no ground for calling any interference in the concurrent findings of the Courts below.

Dismissed.
