The matter pertains to the year 2009. After issuing notice of motion on 29.5.2009, the matt e r has been taken up before the Cour t as many as 19 times, out o f which on six dates i.e.

Out of further five dates t h e matter was adjourned on request of appellant on 17.5.2011 and 1 9 .11.2012 and on rest three dates i.e . 26.11.2010, 19.9.2011 and 19.3.2012 the matter was adjourne d on request of respondent(s). H owever, on eight dates i.e. 03.3.201 0 , 14.7.2010, 17.2.2011, 26.11. 2 011, 10.7.2012, 25.1.2013, 01.9.202 2 and 25.2.2025 the matter w as adjourned due to nonappearan c e on behalf of appellant. Vide o rder dated 19.4.2023 it has been ord e red that “…Legal representati v es of appellant be brought on recor d , who has expired during pend e ncy of proceedings….” . As per offic e report, nothing has been don e till date in this regard by learned counsel for the appellant. On t he last date of hearing i.e. 25.2.202 5 upon no representation on beh a lf of any of the parties, the Registry was directed to intimate to th e parties as well as learned counsel f o r the parties. As per office rep o rt dated 07.11.2025, notice issued to the parties is still awaited. A s per previous office report dated 24 . 7.2025, Mr. Deepak Arora, A dvocate, Mr. Sanjiv Ghai, Advocat e and Mr. Rajesh Kumar G a rg, Advocate have been informed through e-mail, however, there i s no representation on their behalf. E ven today there is no represent a tion on behalf of any of the parties.

However, the needful was not d one till date and vide last orde r dated 25.2.2025, since there was no r e presentation on behalf of either of the parties, the matter was adjourne d and the parties as well as thei r counsel were directed to be intimate d about the next date of hearing. As per office reports, learned c ounsel for the parties were i n formed through e-mail and service u p on the parties is still awaited.

A bare reading of the a b ove facts shows that the appellant has exhibited an utterly casual attitude in the pursuit of the present li t igation. It is to be appreciated t h at very valuable public time of the C o urt has been expended in a ff ording opportunities to the appellant in the interest of justice. On t he other hand, the appellant has adop t ed an utterly casual and careless approach. It is clear that neither t h e appellant nor its counsel are seriously interested in pursuing the present matter. Thus, this Court is left with no other option except to dismiss the same for no n -prosecution.
