Oral order, Punjab and Haryana High Court (Vinod S. Bhardwaj, J.), 04.04.2025, CWP-9567-2025, Jaswinder Jeet Singh v. State of Haryana and Others. The petition sought directions to respondent No.1 to act on a proposal sent by respondent No.3 for amending the Haryana Health Department Pharmacist (Group-C) Service Rules,1998. The court observed that in its ultimate effect the relief sought was a mandamus to the Legislature to carry out a legislative amendment in the said service rules. When confronted with the query as to how such a mandamus could be issued by the High Court in exercise of its powers of judicial review under Article 226 of the Constitution of India, counsel for the petitioner sought withdrawal of the writ petition; learned State Counsel did not object. The petition was dismissed as withdrawn. No substantive adjudication was made and no ratio was laid down on the maintainability of a mandamus directed at the Legislature.
