The petitioner through instant petition under Articles 226 and 227 of the Constitution of India is seeking setting aside of order dated 19.03.2024 (Annexure P-9) whereby his representation has been rejected.

On 21.02.2025, the following order was passed:-

“The petitioner claims that she was selected pursuant to advertisement No.4/2020. She was denied appointment letter on account of an FIR dated 22.09.2020 under Section 376 of IPC. The Investigating Officer filed cancellation report as offence under Section 376 of IPC could not be made out. The trial Court kept the matter pending and petitioner approached this Court seeking direction to trial Court to pass an appropriate order on the cancellation report.

Learned Judicial Magistrate 1st Class accepted cancellation report, however, treated protest petition as private complaint. The matter is pending before trial Court at summoning stage. The cancellation report was filed even prior to commencement of selection process.

On the asking of Court, learned State counsel submits that Competent Authority would consider claim of petitioner in the light of judgment of Supreme Court in Ravindra Kumar vs. State of U.P., (2024) 5 SCC 264.

Adjourned to 02.05.2025.”

Mr. Manish Soni submits that respondent after passing of aforesaid order has conducted petitioner’s medical examination, however, appointment letter is still awaited.

Ms. Palika Monga, DAG, Haryana submits that matter is under active consideration and authorities are verifying documents of the petitioner.

In the wake of statement of both sides, instant petition stands disposed of with a direction to respondent to complete the process within 3 weeks from today.
