Learned State counsel refers to p reliminary objection No.1, to s t ate that as a matter of fact as per Rules mentioned therein, Study Leave could onl y be granted after 5 years of service, while petitio n er had merely 2 years to her cr e dit, still vide the i m pugned order application of t h e petitioner for admission to B . Sc. (Post Basic N u rsing) Course for the Session 1 995-97, was forwarded to the P GI albeit with the impugned condition that she w o uld not claim any financial be n efit or promotion in service, on account of havi n g done the said Course. This w as categorically a ccepted by her by filing an affidavit, attested by the Execu t ive Magistrate o n 12.07.1995 (Annexure P2). H owever, after completion of s aid course and th a t too in the year 2003, challeng e has been made. 3. D isposed of, reserving the petiti o ner with a liberty to get it revi v ed, in case need a r ises.
