Prayer made in the present petition is for directing the respondent s to consider the claim of the p etitioner for appointment as a Multi-Purp o se Health Worker (Female) un d er SC (R&O) Category. 2. The submission of learned c ounsel is that the petitioner obtained 5 1 marks and respondent No.5 al s o had the same marks but has been appoi n ted despite he being also elder i n age.

Learned State counsel, on i n structions, states that the last selected ca n didate in the category under w h ich the petitioner applied had secured 53 marks and as such, she coul d not be appointed. Insofar as respondent No.5 is concerned, she has been considered in General Category, b eing less than 37 years, th e upper age limit prescribed, whereas th e petitioner could not be as she w as 40 years & 4 months at the time of A dvertisement, which fact he r learned counsel could not controvert.
