Through the instant petition , cast under Article 226 of t he Constitutio n of India, a prayer is made for q uashing of letter dated 14.11.2 0 24 (Annexure P-6), whereby, permission to organize Sufiana Jod Mela, w as withdrawn, which was earlier granted, b y drawing an administrative or d er dated 08.11.2024 (Annexure P-3).

The prayer made in the inst a nt petition, has in fact, rende r ed infructuous , as the date for organizing the S ufiana Jod Mela, has already b e en elapsed. Th e perusal of the impugned order dated 14.11.2024 (Annexure P - 6), reflects tha t the permission to organize Su f iana Jod Mela was withdrawan, as some of th e residents of the village Tund, have opposed the said event, a nd after consi d ering the ground situation, that organizing the above Mela, mi g ht lead to clas h es, and therefore, the impugne d order was accordingly passed.

Learned counsel for the petiti o ner submits that the petitione r is still willing to organize the Sufiana Jod M ela, and for the said purpose, he wishes to a p proach the competent authoriti e s concerned. However, she furt h er made a sub m ission that a mandamus be pas s ed upon the authorities concerned, to re-consi d er the application, if any, filed by the petitioner for granting s u ch permission, in accordance with law. 4. In view of the above submissi o ns, this Court is of the conside r ed opinion th a t the prayer made for issu a nce of a mandamus, upon t he respondent s , is bona fide and innocuous. 5. In case, the petitioner within 15 days from today, approach t he Deputy Commissioner concerned, by filing apt application for grant i ng permission to organize Sufiana Jod Mela, t he latter shall, in accordance w ith law, and after evaluating the ground situati o n, decide the same.
