Rajat Vs Punjab and Sind Bank and Ors.

Prayer in the present petition is for issuance of a direction to the respondents to provide employment to the petitioner on compassionate grounds and/or, in the alternative, to grant ex gratia financial assistance on compassionate grounds, in accordance with the Scheme/Policy dated 10.12.2007, together with interest on the delayed payment, the petitioner being a dependant.

Learned counsel appearing for the petitioner submits that the deceased, Joginder Kumar, father of the petitioner, was serving with the respondent-Bank as a Branch Manager and, unfortunately, passed away on 11.06.2016 during the course of his service, leaving behind the petitioner, his wife Smt. Saroj Bala (widow of the deceased and mother of the petitioner), and one daughter, Ms. Anjali (sister of the petitioner). majority, having successfully completed his Senior Secondary education. It is contended that an application seeking compassionate appointment and/or ex gratia payment under the Compassionate Appointment Scheme was submitted in September 2016; however, the same remained undecided owing to a dispute between Smt. Kalawati (mother of the deceased and grandmother of the petitioner) on one side, and the petitioner along with his widowed mother on the other. It is further submitted that the civil suit for injunction filed by the petitioner was dismissed by the learned Civil Judge (Jr. Divn.), Yamuna Nagar at Jagadhari, but in appeal, the Appellate Court, vide judgment and decree dated 01.08.2025, partly allowed the claim and directed that the Death-cum-Retirement benefits be apportioned equally amongst all Class-I legal heirs of the deceased Joginder Kumar.

In view of the subsequent developments, it is observed that the respondents are required to take an appropriate decision on the petitioner’s pending claim for compassionate appointment.

Learned counsel appearing on behalf of the respondent-Bank submits that they are not seized of the judgment rendered by the learned Additional District Judge, Yamuna Nagar at Jagadhari. It is stated that the petitioner’s claim for compassionate appointment and/or ex gratia financial benefits had been kept pending at the relevant time owing to the pendency of the civil suit between the parties, which created uncertainty as to the rightful beneficiary. However, it is fairly submitted that, in light of the subsequent developments, there is no objection to reconsidering the petitioner’s claim afresh.

Consequently, the writ petition is disposed of with a direction to the respondents to consider the claim of the petitioner for compassionate appointment/ex-gratia financial benefits in terms of the applicable policy after taking into consideration the judgment and decree dated 01.08.2025 passed by the Additional District Judge, Yamuna Nagar at Jagadhari in Civil Appeal No.100 of 2019.

Let the needful be done within a period of 4 months of receipt of a certified copy of this order.
