This writ petition has been filed under Article 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to grant the benefit of deemed date of appointment with all consequential benefits, such as seniority, pay, and pensionery benefits, re-fixation of pay and pension etc., to the petitioner w.e.f. 25.04.1990 at par with similarly situated employee, namely Sh. Narender Kumar, Assistant working in the office of respondent No.2 who has been granted vide office order dated 17.04.2025 (Annexure-P/1), in compliance with order dated 06.05.2025 (Annexure-P/2) passed by this Hon'ble High Court in CWP No.26485 of 2018 titled as Narender Kumar Vs State of Haryana and another and office order dated 13.03.2016 (Annexure-P/3) passed during pendency of CWP No.27349 of 2015 which was disposed of vide order dated 18.08.2017 (Annexure-P/4) by this Hon'ble Court and refix the pay and pension and release the arrear with interest @18% per annum.

At the outset, learned counsel for the petitioner submits that he will be satisfied, in case a direction is issued to respondent No.2 to consider the legal notice dated 07.04.2025 (Annexure P-9) within a time bound manner in view of the judgment dated 30.09.2015 passed in CWP-24527-2013 titled as ‘ Dharam Singh vs. State of Haryana and ors.’

Mr. R.S.Budhwar, Advocate learned Additional Advocate General, Haryana, having served with an advance copy of the petition, accepts notice on behalf of the respondent-State and assures the Court that the legal notice dated 07.04.2025 (Annexure P-9) shall be decided by passing a speaking order in accordance with law.

In view of the above, and without adverting to the merits of the case, the respondent No.2- Director, Department of Economic and Statistical Analysis, Haryana is directed to consider and decide the legal notice dated 07.04.2025 (Annexure P-9), in view of the judgment dated 30.09.2015 passed in CWP-245272013 titled as ‘ Dharam Singh vs. State of Haryana and ors,’ after providing opportunity of hearing to the parties, by passing a speaking order in accordance with law within a period of six weeks from the date of receipt of certified copy of this order.
