CWP-23959-2014 (High Court of Punjab and Haryana at Chandigarh, Jagmohan Bansal, J., decided 05.09.2025): Petition under Articles 226/227 of the Constitution of India by Manjeet Singh, a member of the Executive Clerical Cadre absorbed in the Accounts Branch vide order dated 13.10.2012 w.e.f. 03.08.2012, seeking setting aside of order dated 03.10.2013 whereby a condition of three years' service in the Executive Clerical Cadre was imposed for his promotion, he having been denied promotion as Head Constable. In compliance of order dated 29.05.2023 passed by this Court in CWP No.11062 of 2017, the respondents (affidavit dated 02.09.2024) reconsidered promotions of Executive Clerical Cadre members, fixed their seniority vide order dated 14.09.2023, assigned the petitioner seniority No.521 and promoted him as Head Constable w.e.f. 24.07.2012; he was further assigned the local rank of ASI. The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 03.10.2013 whereby condition of three years’ service in Executive Clerical Cadre has wrongly been imposed for the promotion of petitioner.

The petitioner is part of Executive Clerical Cadre. He was absorbed in Executive Clerical Cadre in Accounts Branch vide order dated 13.10.2012 w.e.f. 03.08.2012 along with other Officials. He was not granted promotion to the rank of Head Constable.

The respondent has filed affidavit dated 02.09.2024 to the effect that in compliance of order dated 29.05.2023 passed by this Court in CWP No.11062 of 2017, the respondent has reconsidered promotion of Members of Executive Clerical Cadre.
