The prayer in the present petition under Section 528 of BNSS, 2023 is for setting aside the order dated 19.07.2008 passed by the CJM, SBS Nagar whereby the petitioner has been declared a proclaimed offender in FIR No.305 dated 06.09.2004 (Annexure P-2) registered under Sections 452, 323, 427, 34 IPC and all consequential proceedings arising therefrom.

On 28.01.2025, the following order has been passed:-

“Contends that non-appearance of the petitioner was not intentional; rather he was not properly advised by his counsel. Also submits, on instructions, that petitioner is ready to bear costs of Rs.5,00,000/- on account of his inadvertent lapse.

Notice of motion.

At this stage, Mr. Kunwarbir Singh, learned A.A.G, Punjab, accepts notice on behalf of respondent No.1-State; seeks time to have instructions and/or to file written response in the matter.

On 28.02.2025 the following order has been passed:-

“Mr. Vansh Chawla, Advocate, causes representation and files Power of Attorney on behalf of respondent No.2. Learned counsel for the petitioner has apprised the Court that in compliance of order dated 28.01.2025 passed by this Court, costs of Rs.5,00,000/- have already been deposited, vide receipt dated 06.02.2025.

On request of learned counsel for the petitioner, posted for 09.04.2025.

In the meanwhile, petitioner shall join the proceedings before the Court of competent jurisdiction within a period of four weeks and in the event of doing so, he be released on interim bail in the present case till the next date of hearing on his furnishing adequate bail/surety bonds subject to its satisfaction.”

In furtherance to the aforementioned orders, the petitioner has surrendered before the concerned Court and has since been released on interim bail. The copy of the order dated 25.03.2025 passed by CJM/SBS Nagar is marked as A .

In view of the above, no further orders are required to be passed by this Court.
