As per the prosecu�on allega�ons, complainant Yadpreet Singh @ Yadi runs a branded cloth showroom near Grain Market in Village Aspal Kalan. He had adver�sed for a lucky draw on the eve of new year comprising the items i.e. car make Audi, LCD, Honda Civic etc. It is alleged that Gurmeet Singh @ Kala demanded ransom from the complainant asking him on mobile to take out a draw of Audi car in his name otherwise he would be killed. It is further the allega�ons that said Gurmeet Singh @ Kala along with Guri Singh, Kuldeep Singh @ Deep Singh and 3-4 unknown persons came to the showroom of complainant and threatened him by showing pistol. Amount of ₹50,000/- and ₹1,00,000/- were given on 01.12.2022 to Gurmeet Singh @ Kala but said Gurmeet Singh and his companions kept on threatening the complainant. It is also alleged that all of them forcibly entered the showroom and insisted the complainant to go to the house of Gurmeet and they picked up readymade garments from the showroom.

It is contended by learned counsel that pe��oner is not named in the FIR; that main accused Gurmeet Singh @ Kala has been killed by the police in encounter; that co-accused Kuldeep Singh @ Deep as named in the FIR has already been allowed bail by this Court vide order dated 09.09.2024 passed in CRM-M-29184-2024. It is on the disclosure statement of the said Kuldeep Singh @ Deep that pe��oner was nominated and that no recovery was effected from the pe��oner. It is further contended that statement of complainant Yadpreet Singh @ Yadi has already been recorded during trial, copy of which is Annexure A-1 and in which he categorically stated that pe��oner Kuldeep Singh s/o Nand Singh had never come to his shop and had never commi/ed any extor�on. It is also the conten�on of learned counsel that pe��oner is in custody for the last

approximately 01 year and that trial may take long �me and so, he be allowed bail.

Learned State counsel could not refute the aforesaid conten�ons to the effect that pe��oner is not named in the FIR nor any recovery was effected from him. It is also not disputed that complainant Yadpreet Singh @ Yadi in his tes�mony during trial has not supported the prosecu�on version qua pe��oner.

Apart from above, Kuldeep Singh @ Deep, who had nominated the pe��oner in disclosure statement has already been allowed bail by a co-ordinate Bench of this Court vide order dated 09.09.2024 passed in CRM-M-29184-2024 �tled as “Kuldeep Singh v. State of Punjab”. Another co-accused Sukhchain Singh @ Cheena was allowed bail by the trial Court on 13.07.2023. As per the custody cer�ficate, pe��oner is in custody for the last 11 months and 28 days. No purpose shall be served by keeping the pe��oner detained.

Having regard to the above facts and circumstances, but without commen�ng anything further on the merits of the case, this pe��on is allowed and pe��oner is admi/ed to bail on his furnishing bail bonds/surety bonds to the sa�sfac�on of the Learned Trial Court/Duty Magistrate concerned, on usual terms and condi�ons.
