The petitioner is seeking the c oncession of anticipatory bail , under Secti o n 482 of BNSS, 2023, in case FIR No.241, dated 19.11.2024 , under Secti o ns 109, 118(1), 118(2), 126(2) , 127(2), 351(2), 351(3), 324(4) , 191(3) and 190 of BNS, 2023, registered a t Police Station Division No.6 , Jalandhar D istrict Police Commissionerate, Jalandhar.

On 01.04.2025, while notici n g the following submission s made by th e learned counsel for the petiti o ner, this Court had granted th e concession of interim bail to the petit i oner and asked him to joi n investigatio n :-

“Learned counsel for t h e petitioner inter alia contend s that a perusal of the FIR anne x ed as Annexure P-1 reveals tha t the petitioner has neither be e n named therein nor has an y injury been attributed to hi m even as per the disclosur e statements suffered by all the o ther coaccused, including prim e accused Pawan on whose discl o sure statement the petitioner

came to be nominated as an accused in the present case. It has been submitted that the only role, if any, attributed to the petitioner is of being a part of the unlawful assembly which attacked the complainant.”

Learned counsel for the petitioner submits that in compliance of order dated 01.04.2025, petitioner has joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions from ASI Kulwinder Singh, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 01.04.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
