The petitioner is seeking the concession of anticipatory bail in FIR No.197 dated 23.12.2021 under Sections 307, 324, 323, 148, 149, 120-B of the Indian Penal Code, 1860, and Sections 25 and 27 of The Arms Act registered at Police Station Kot Ise Khan, District Moga. 2. Vide order dated 08.05.2025, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:-

“It is the contention of learned counsel for the petitioner that the petitioner has been falsely implicated in this case. The present FIR was registered in the year 2021, however, with the intervention of respectables, a compromise has been effected between the parties on 14.02.2022, which is annexed with the petition as Annexure P-2 and till date the petitioner was not called by the police to join the investigation. He contends that even as per the allegations, the injury attributed to the

petitioner is simple in nature, which is not on the vital part of the body and there is no firearm injury attributed to the petitioner. Hence, prays for grant of anticipatory bail.”

Learned counsel for the petitioner submits that in compliance of order dated 08.05.2025, the petitioner has joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions from ASI Parvinder Singh, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 08.05.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
