Present petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of anticipatory bail to the petitioner in case FIR No.41 dated 27.02.2025, under Sections 115(2), 118(2), 127(1), 3(5) of Bharatiya Nagarik Suraksha Sanhita, 2023, registered at Police Station City Moga, Moga.

‘Prayer is for grant of anticipatory bail in case having FIR No.41 dated 27.02.2025 registered under Sections 115(2), 118(2), 127(1), 3(5) of BNS, 2023, at Police Station City Moga, District Moga (Annexure P-1/T). Learned counsel for the petitioner inter alia contends that the petitioner is falsely named in the FIR and otherwise also, only simple injury, that too with a blunt weapon is attributed to the present petitioner. He further submits that now the matter has been compromised and he produced a copy of the concerned affidavit given by the injured Baljinder Singh. investigation with the police.

On asking of the Court, Mr. Jasjeet Singh Dhaliwal, AAG, Punjab accepts notice on behalf of the State. He submits that the petitioner along with his companions caused injuries to complainant Ranjit Singh and one Baljinder Singh. The petitioner is required by the police for the purpose of proper interrogation.

However, the learned State Counsel has not disputed the fact that only simple injury caused with baseball bat, is attributed to the present petitioner. The learned State Counsel prays for time to seek instructions with regard to the affidavit, if any, given by Baljinder Singh injured in favour of the petitioner.

Now, be listed on 08.07.2025.

In the meanwhile, in case of arrest, the petitioner is directed to be released on interim bail by the Investigating Officer/Arresting Officer subject to his own satisfaction. The petitioner should join investigation with the police well in time before the next date of hearing and to abide by the conditions envisaged under Section 482 (2) BNSS.’

Learned State counsel (on instructions) submits that pursuant to

the order dated 19.03.2025, the petitioner has joined investigation and is no longer required for custodial interrogation.

In view of the above, the instant petition is allowed. The interim order dated 19.03.2025, passed by this Court is made absolute, subject to the conditions as enumerated under Section 482(2) of BNSS.

This order should not be treated as “blanket” order. It will not be read granting petitioner indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence.
