Iqbal Singh Vs State of Punjab and Another

This petition has been filed under Section 528 BNSS seeking quashing of FIR No.156 dated 07.07.2018 registered under Sections 294, 506 of Indian Penal Code at Police Station Nakodar Sadar, District Jalandhar Rural Punjab, on the basis of compromise dated 15.02.2025 (Annexure P-2) along with all subsequent proceedings arising therefrom.

The following order was passed on 19.03.2025:

“At the outset, learned counsel for the petitioner submits that there is a typographical error in the present petition, as the Section under which the FIR is registered is Section 294 of IPC and has been wrongly typed as Section 295 of IPC. The said correction be permitted to be rectified in the head note and in the averments of the petition as well as in the prayer clause in the Court itself.

The present petition has been filed for quashing of the FIR No.156 dated 07.07.2018 registered under Sections 294 and 506 of the Indian Penal Code registered at Police Station Nakodar Sadar, District Jalandhar Rural, Punjab (Annexure P-1) and all subsequent proceedings arising therefrom on the basis of the compromise dated 15.02.2025 arrived at between the petitioner and the respondent No. 2/complainant. (Annexure P-2).

Mr. Subhash Godara, Addl. A.G. Punjab appears and accepts notice on behalf of respondent-State. Mr. Rahul Garg, Advocate has put in appearance on behalf of respondent No. 2 and files his Power of Attorney in Court today, which is taken on record and has not denied the factum of compromise effected between the parties.

Both the parties are directed to appear before the concerned Illaqa/Duty Magistrate on 22.04.2025 or any other date, as the Court below may decide or fix for recording their statements, who shall record their respective statements with regard to the genuineness/correctness of the compromise and that the compromise is not the result of any fraud or misrepresentation and is the result of free will of the parties. It would also be verified that besides the accused (petitioner) mentioned in the petition, there is no other accused in the FIR and the parties are not involved or declared proclaimed offender in any other criminal case.

The Illaqa Magistrate/Duty Magistrate shall send his/her report through learned Sessions Judge concerned on or before the date fixed before this Court.

genuine and arrived at without any pressure or coercion from anyone.

In view of the compromise and the ratio of law laid down by the Hon’ble Supreme Court in Narinder Singh and others vs. State of Punjab and another, (2014) 6 SCC 466 and Shakuntala Sawhney (Mrs) Vs. Kaushalya (Mrs.) and others (1980) 1 SCC 63 and Full Bench of this Court in Kulwinder Singh Vs. State of Punjab 2007 (3) RCR (Crl.) 1052 , this petition is allowed and FIR No.156 dated 07.07.2018 registered under Sections 294, 506 of Indian Penal Code at Police Station Nakodar Sadar, District Jalandhar Rural Punjab, on the basis of compromise dated 15.02.2025 (Annexure P-2) along with all subsequent proceedings arising therefrom are quashed, qua the petitioner.
