Th e petition has been filed, seekin g a direction to decide Executio n Application no.429 of 2024 titled Jai Bhush a n Malik v. Water Supply an d Sewerage Boar d ; instituted on 13.09.2024, in a t ime bound manner. 2. Le a rned counsel contends that the petitioner is a registere d contractor und e r the MSME Act, 2006, and h as been allotted a contract fo r providing and layering of lateral sewer & main/outfall sewer includin g construction of m anholes, making house conne c tions and construction of roads , and all other w o rks contingent thereto at Amlo h , District Fatehgarh Sahib, vid e agreement No. 2 7 of 2016-17. Timely payme n ts were not made to him an d disputes arose b etween the parties, leading to a rbitral proceedings which wer e concluded by p a ssing of award dated 11.07.202 4 , Annexure P-1. The petitione r has filed afore m entioned execution applicatio n for enforcement of the award , against which t h ere is no stay by any court o f law. been finally de c ided. He has relied upon the d i rections issued by the Suprem e Court in Periyammal (Dead) and others v. Raj a mani and another, 2025 INS C 329, requiring the District Judiciary to dis p ose of the pending executio n petitions within a period of six months, without fail. 3. Ke e ping in view the directions b e ing issued service of notice o n the respondent h as been done away with, as it w ill not cause any prejudice. 4. Ke e ping in view the facts aforeme n tioned and the directions issue d in Periyammal case ( supra ) , it is deemed appr o priate to dispose of the petitio n with a direction to the Executing Court to decide the pending executio n application bea r ing no.429 of 2024 expeditious l y, preferably within a period o f four months fro m receiving a certified copy of t h e order.
