Challenge in the present p e tition is to the order dated 23.1.202 5 (Annexure P-1) passed by th e learned Additional District Judge, R upnagar whereby application filed by the petitioner for staying t h e proceedings of the impugne d judgment dated 20.7.2023 (Annexu r e P-2) passed by the learn e d Civil Judge (Jr. Divn.), Rupnaga r has been dismissed.

Learned counsel for the p e titioner, at the very outset, submits t h at the petitioner is not pressing the main relief sought in the present r e vision petition i.e. setting asi d e the order dated 23.1.2025 (Annexu r e P-1), however, prays that a direction be issued to the learned A dditional District Judge, Rupna g ar to dispose of the pending appeal e x peditiously. Learned counsel fo r the petitioner has referred to para 7 ( c) (at page 8) of the petition, w h ich reads as follows :-

“7(c) That it is a co m mon practice and normally seen these days that o nce either of the party gets interim relief in his/ h er favour, then, such party prolongs the litigatio n by adopting all means. The plaintiff apprehends t h is from situation to happen in the appeal that h as been preferred by the defendant before the l earned first appellate court, who passed impugne d order, so as to enjoy the possession of the plo t in dispute till pendency of the appeal. The plain t iff, although, challenges the impugned order date d 23.01.2025 by terming it to be illegal on all aspe c ts and at the same time, the plaintiff humbly subm i ts that in case, the impugned order is upheld and in that situation, a direction be issued to the learned f irst appellate court to decide the main appeal, out o f which impugned order has arisen, in a time bou n d manner that this Hon'ble Court may deem fit.”

Keeping in view the fact that the appeal before the learned A dditional District Judge, Rupna g ar has been filed only in the year 202 3 , no ground to issue any direct i on to the learned Additional District J u dge, Rupnagar for expeditious disposal of the said appeal is made out .
