Priya Saini Vs Dr. D.K. Tiwari and Others

Prayer in this petition is for initiation of contempt proceedi n gs against the respondent(s) for n ot complying the order dated 17.2.202 5 (Annexure P-1) passed by a co - ordinate Bench of this Court in CWP-1841-2025 titled as “Priya Saini v s . State of Punjab and others”. In compliance of last order d ated 28.5.2025 passed by this Court, th e respondents are present in the C o urt.

It is submitted by learned c o unsel for the petitioner that vide orde r dated 17.2.2025 passed in C W P-1841-2025 titled as “Priya Saini vs. S tate of Punjab and others”, the p etitioner was granted interim relief in same terms as in Civil Writ P e tition No.25121-2023. The interim d i rection dated 07.11.2023 (Anne x ure P-2) granted in the said CWP-25121-2023 reads as follows :-

In the meanwhi l e, the effect and operation of orders dated 25.8.202 3 and 29.8.2023 shall remain stayed. Petitioner sha l l be allowed to continue. xxx xxx xx x ” Learned counsel for the petitioner submits that in pursuanc e of the said order, the petitioner had duly reported for joining on 18^th a n d 19^th of February, 2025 but she was not allowed to join work at her sea t and the petitioner was made to s it outside on bench for whole two days and was told by respondent No.4 that they have no instructions to let her join. In support of her submis s ions, learned counsel for the petitioner has appended her attendance re g ister (Annexure P-2). Further submits t h at petitioner shall report for dut y tomorrow itself and she may be permit t ed to join duty without any obstr u ction from the respondents. Learned counsel for the re s pondents-State refers to the reply dat e d 03.7.2025 by way of affidavit of Shri Rajpal Singh Sekhon, PCS, Re g ional Transport Officer, SAS N a gar to submit that as on date, the respo n dent No.4-RTA stands suspend e d vide order dated 07.2.2025; and the present incumbent Shri Rajp a l Singh Sekhon, Regional Transport Authority, SAS Nagar is present in the Court. It is pointed out that the petitioner has not come to the of f ice after 19.2.2025. Learned counsel f o r the State, on instructions, un d ertakes that there shall be no impedim e nt on behalf of the respondents i n case the petitioner now joins the servic e .

Learned counsel for the Sta t e further refers to the order dated 07. 1 1.2023 passed in CWP-25121- 2 023 (at page 12 of the paper book) w h erein liberty has been granted t o the respondents to conduct enquiry. It is pointed out that as stated i n para 12 of the reply dated

03.7.202 5 , there are three vigilance co m plaints pending against the petitioner . It is submitted that the respond e nts be allowed to conduct the said enq u iries against the petitioner i n terms of the order dated 07.11.20 2 3 passed in CWP-25121-2023. It is additionally pointed out by learne d State counsel that in the first en q uiry i.e. Vigilance Complaint No.651/2 0 23, enumerated in para 12 of th e reply dated 03.7.2025, upon enquiry, v ide report dated 03.7.2025, the p e titioner has been held guilty. Be that as it may, needless to say that in terms of order dated 07. 1 1.2023 passed in CWP-25121-2 0 23 titled as “Deepak Sharma vs. State o f Punjab and others”, the respon d ents are at liberty to continue with any e nquiries pending against the peti t ioner. Further, in view of the undertaki n g of learned counsel for the pet i tioner that the petitioner shall report on duty tomorrow i.e. 11.7.2025; and the fact that learned counsel for the State, on instructions has also giv e n undertaking that there shall be no im p ediment in permitting the petitioner to join the duty tomorrow i.e. 11.7. 2 025, the present petition stands disposed of .
