Contempt Petition (COCP-53-2025, High Court of Punjab and Haryana, Nidhi Gupta, J., 01.09.2025): Virender Singh alleged non-compliance by Vineet Garg and another of order dated 20.03.2024 (Annexure P-1) passed by a co-ordinate Bench in CWP-20149-2016 ('Virender vs. State of Haryana and others'), which was disposed of in terms of order dated 13.03.2024 in CWP2152-2020 ('Ashish Sharma and others vs. State of Haryana and others'); para 43 thereof directed speaking orders on regularization, notional retrospective regularization without arrears up to the date of filing, and fixation/revision of salary and pensionary benefits with arrears from the date of filing. The respondents' LPA2562-2024 was dismissed by a Division Bench on 04.11.2024, but in SLP (Civil) Diary No. 24369-2025 the Hon'ble Supreme Court, vide order dated 29.05.2025, directed that operation of the impugned order shall remain stayed; that order was taken on record. None appeared for the petitioner even in the second round of hearing. The present contempt petitio n has been filed alleging noncomplianc e of order dated 20.03.2024 (Annexure P-1) passed by a co-ordinat e Bench of this Court in CWP- 2 0149-2016, titled as ‘Virender vs. State o f Haryana and others’ and ot h er connected petition(s) which were disp o sed of in terms of order date d 13.03.2024 passed in CWP2152-2020, titled as ‘Ashish Sharma and o thers vs. State of Haryana and

others’ wh e reby the respondents have bee n directed as under:-

“43. In view of the above, t h e writ petitions are disposed o f in the terms and conditions m entioned herein before. Let the respondent-State pass app r opriate speaking order as directed herein before. In cas e , any of the petitioner is found entitled for regularization/r e trospective regularization o f services from the date emplo y ees junior to him/her has been regularized, they will be granted the said date o f regularization otherwise du e reasons be mentioned in the speaking order keeping in m i nd the directions given by the Court herein before so as t o decide the eligibility of each

petitioners qua their respecti v e claims. Further in case any of the petitioners is found e n titled for regularization of his services retrospectively the said benefit shall be given notionally, no arrears will be granted to the petitioners up to the date of filing of the resp e ctive petitions. The petitioners will be entitled for fixing of their salaries from the date o f regularization notionally a n d the arrears will only be extended from the date of fil i ng of their respective petitions before this Court and if any of the petitioners has already retired, his/her pensionary b e nefits will also be fixed/revised and arrears will also be exte n ded from the date of filing the petition by the said petitioner.”

It is submitted by learned c o unsel for the respondents that against th e aforesaid order dated 13.03. 2 024, an appeal bearing LPA2562-2024, titled as ‘State of Haryana an d others vs. Virender’, has been filed by th e respondents which was dismis s ed by a Division Bench of this Court vid e order dated 04.11.2024; agai n st which SLP (Civil) bearing Diary No. 24369-2025, has been filed b y the respondents in which the Hon’ble S u preme Court vide order dated 2 9.05.2025, has been pleased to direct tha t ‘operation of the impugne d order shall remain stayed’. Learned c o unsel for the respondents subm i ts that in view of the above, no contempt i s made out against the responde n ts.

A copy of the order dated 29. 0 5.2025, passed by the Hon’ble Supreme C ourt, handed over in Court by learned counsel for the responden t s is taken on record.
