Ld. counsel contends that orig i nal appellant had expired and that as per the in f ormation provided by the LRs of t he appellant, they are not intere s ted to pursue the appeal. However, there is no written communication in this re g ard on the pa r t of the LR of appellant.

Perusal of the record woul d reveal that suit for recover y of ₹15,900/- filed by the plaintiff (appellant herein) was dismissed by the trial C o urt on 06.04. 1 996 and appeal filed against the s aid order, was also dismissed by the First App e llate Court on 07.09.1999 and thus the appellant is before this C o urt against th e concurrent findings of the Court s below.

Having noticed these facts an d the information provided by th e ld. counsel f o r the parties, this appeal is hereb y disposed of with liberty to the L e gal Represen t atives of the appellant to approa c h this Court to get the same revived in case, a n y cause of action is till surviving.
