Th e instant writ petition has b e en filed seeking issuance o f directions to t h e Family Court to allow the p etitioner to give her evidenc e through Video C onferencing in the petition f i led by her under Section 13(1 ) (IA) (IB) of the Hindu Marriage Act, 1955.

Le a rned counsel contends that the p etitioner is residing abroad an d that she wanted to get her evidence recorded th r ough Video Conferencing mod e in a petition pe n ding before the Family Court b ut the application for the sam e has not been ac c epted.

Le a rned counsel appearing on behalf of the respondents, however , contends that the respondents have already bee n proceeded against ex parte an d that the peti t ioner is at liberty to fi l e an affidavit giving he r testimony/depo s ition and that the matter s h all be processed as per la w thereafter.

In v iew of the aforesaid statement , counsel for the petitioner doe s not press the in s tant petition at this stage so as to avail the remedy of filing a n affidavit before the Family Court. Di s posed of with the liberty as afo r esaid.
