Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, quashing the show cause notice dated 20.09.2021 (Annexure P-1), charge-sheet dated 18.09.2018 (Annexure P-2) and enquiry report dated 06.03.2021 (Annexure P-3). Further a writ of mandamus has been sought for directing the respondents to release the withheld retiral dues including employer share towards provident fund, leave salary encashment and gratuity of the petitioner along with interest @ 12% p.a. from the date it became due.

Learned counsel for the petitioner, at the very outset, confines his prayer for deciding representation dated 31.07.2024 (Annexure P-15). He submits that at this stage, petitioner would be

satisfied, if the said representation is decided by passing a speaking order within a time bound frame.

I have heard learned counsel for the petitioner and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.2 to decide representation dated 31.07.2024 (Annexure P-15), submitted by the petitioner expeditiously, by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
