Aggrieved by non acceptance of the application seeking regular parole leave for a period of 10 weeks [under section 3 of Haryana Good Conduct Prisoners, (Temporary Release) Act, 2022] to attend the wedding of his real nephew on 05/06.10.2024, the convict has come up before this Court by filing the present writ petition.

Notices served upon the official respondents through the State's counsel. Given the nature of the order that this Court proposes to pass, neither the response of official respondents nor the issuance of notices to the private respondents is required.

Let the application made by the petitioner be accepted and also the factum of marriage be verified through the concerned SHO immediately. If the factum of marriage of his real nephew is found to be true then concerned Superintendent of Jail, decide his application within 02 days thereafter and shall ensure his release on parole timely in accordance with law. In case, the concerned Officer rejects the said application then such order must be a reasoned order. Attending the family function(s) of a close relative like of a Bhanja’s wedding is crucial in our Society because as per norms and customs of the Society, a family expects voluntary contribution from the maternal uncle (‘ Mama’ ) of the Sonia Puri bridegroom/ bride in various marital ceremonies/ rituals. concerned Superintendent of Jail to keep this fact in mind in case the said Officer intends to reject such application.
