The present petitioner who is suffering incarceration in the prison concerned in pursuance to his becoming convicted and sentenced by the learned Additional Sessions Judge, Kaithal, in respect of FIR No.245 dated 23.10.2017 embodying therein an offence under Section 302 of the IPC. However, during the phase of his serving the apposite sentence in the prison concerned, he has instituted the instant petition before this Court, whereby he seeks to avail emergency parole to enable him to execute and present certain documents for registration before the Sub Registrar concerned.

The learned State Counsel has placed on record a verificatory report, reading whereof, discloses that the present petitioner owns about 58 kanal and 15 marlas of land. Furthermore, it is also disclosed therein that through appointment slip bearing Token No.05516042024023515000 dated 16.04.2024, he has been given an appointment for registration of a Will. It is also disclosed therein that the said appointment for the said purpose is for DIWAKER GULATI 2024.04.26 16:27 30.04.2024 at 09:00 AM in the office of the Sub Registrar concerned. In the face of above verificatory report placed on record by the learned Deputy Advocate General, this Court proceeds to allow the petitioner’s claim for relief of emergency parole. The Superintendent of the jail concerned shall deploy two armed guards along with the present petitioner so that they accompany the present petitioner to the office of the Sub Registrar concerned on 30.04.2024, and, in the evening of 30.04.2024 the armed guards shall retrieve the present petitioner into the prison concerned.

It is clarified that since the petitioner claims and is accorded emergency parole, thereby in terms of the relevant rules, which forbid the State of Haryana to levy any expenses towards the transportation of the armed guards deployed with the present petitioner, thereby the said transportation expenses shall not be levied or charged upon the present petitioner.
