having addi t ional responsibility of his sec o nd family; d) it has not bee n denied by t h e petitioner side that the resp o ndent is permanently disable d due to injuri e s sustained by him in a roadsi d e accident, as a result of whic h he is unabl e to walk properly; and e) th e fact that the mother of th e petitioner is a practicing Advocate in Distri c t Sonepat, it is my considere d view that it w ill serve the ends of justice if the amount of maintenance o f Rs.5,000/- per month awardedvide the i m pugned order, is enhanced t o Rs.7,000/- p e r month. The same is to be pa i d in the manner and as per th e terms and conditions as mentioned in the impugned order to the effec t that “…pay m ent of future maintenance all o wance w.e.f. date of this orde r to the petiti o ner by first week of every month in the account of the mothe r of petitione r bearing Account No.50100223 7 68411, HDFC Bank, IFSC Code : HDFC00025 5 7, Sonipat. In case of default i n payment qua arrears or futur e maintenanc e allowance, he shall be liabl e to pay an additional sum o f Rs.500/- to the petitioner, for every mont h 's default. In case responden t fails to pay t he sum, petitioner shall have a right to seek the same throug h process of the court….”
