The FIR in question was lodged pursu a nt to a letter sent by Registra r Cooperat i ve Society, Kurukshetra, wher e in it is alleged that President o f the Ajoo n i Co-operative NATC Commi t tee, Sector 17, Kurukshetra i.e . Bhagwan t Singh Gill as well as the Ass i stant Manager, namely, Meen u Khanna a long with other members of t he family had cheated severa l members . It is the case of prosecution t h at pursuant to investigation, i t surfaced t hat 15 persons had made a com p laint with regard to the fraud i n

question, whereas another 65 persons had also come out with th e allegatio n s that they had also deposited amounts in the said committee . As per the case of prosecution, while ac c used Meenu Khanna is wife o f Bhagwan t Singh Gill, the petitioner is s i ster-in-law ( Jethani ) of Meen u Khanna. I t is further the case of prosecut i on that a total of Rs.58,20,990/ - was siph o ned off by the accused.

Learned c ounsel for the petitioner submi t ted that the petitioner has bee n falsely i m plicated in the present case and that she had no role whatsoeve r in the a ff airs of the committee though she is a member. It has bee n submitte d that there is no evidence w orth credence with regard t o involvem e nt of the petitioner.

Opposin g the petition, learned State cou n sel submitted that having regar d to the fa c t that the petitioner is closely r elated to Meenu Khanna bein g her sister - in-law ( Jethani ) and also the f a ct that she is also a member o f the com m ittee and during investigatio n sufficient evidence has bee n collected against her, her complicity is clearly evident. Learned Stat e counsel h as, however, informed that th e petitioner as on date has bee n behind b a rs since the last about 3 months and is otherwise not involved i n any other case.

This Cou r t has considered rival submissi o ns addressed before this Court.

Without c ommenting anything as regard s the veracity of the allegation s against t h e petitioner, but keeping in vie w the fact that the petitioner is a lady age d about 42 years and has been b e hind bars since the last about 3 months a n d has a clean record, her furt h er detention would be justified .
