“The petitioners seek grant o f anticipatory bail in respect of a cas e registered against him vide FI R No.93, dated 30.6.2019, Polic e Sta t ion Siwan, District Kaithal, unde r Sections 323, 324, 326, 354-B/3 4 IP C .

Learned counsel submits that ever since when he was grante d bai l in the year 2019 in respect of of f ences other than Section 307 IPC , pet i tioners have not misused the con c ession of anticipatory bail. It ha s

Meanwhile, in the event of ar r est, the petitioners be released o n int e rim bail subject to their furnishin g personal bonds and surety bond s to the satisfaction of Arresting/Investigating Officer. However, th e pet i tioners shall join the investigatio n as and when called upon to do s o an d cooperate with the Arresting/In v estigating Officer and shall abid e by t he conditions as provided under S e ction 438 (2) Cr.P.C.

At this stage, Mr. Gaurav Datta, Advocate has put in appearanc e on behalf of the complainant and h a s filed memo of appearance. Th e sa m e is taken on record. Power of att o rney be filed on or before the nex t dat e of hearing.”

Learned S tate counsel upon instruction s has informed that pursuant t o interim d i rections issued by this Court, both the petitioners have sinc e joined in v estigation and are not required f or any custodial interrogation.

Having r e gard to the aforestated positi o n, wherein the petitioners ar e stated to h ave joined investigation and a r e not required for any custodia l interroga t ion, the petition is accepted an d the interim directions issued b y this Cour t vide order dated 14.08.2024 a r e hereby made absolute subjec t to the co n dition that the petitioners shal l join investigation as and whe n called upon to do so and cooperate wit h the Investigating Officer an d shall also abide by the conditions as prov i ded under Section 482 BNSS.

The petit i oners are also directed to assoc i ate with the proceedings of tria l regularly and also to appear before the P o lice in case required.
