“The petitioner seeks grant o f anticipatory bail in respect of a cas e registered vide FIR No.0028, dated 2.3.2024 at Police Statio n M u llanpur, District SAS Nagar, un d er Sections 406, 420, 120-B o f Indian Penal Code.

Learned counsel for the petitio n er submitted that the complainan t ha d been allotted first floor of plot in question on 17.6.2017 by M/ s Go l den Oak Real Estate Private Lim i ted but subsequently the said plo t has been transferred by the petitione r being the attorney holder of ‘M/ s Sa n skriti Golden Oak Real Estate P rivate Limited’ to someone else , alt h ough the complainant had paid a substantial amount of Rs.46.7 0 lak h s.

Learned counsel for the petiti o ner submitted that as a matter o f fac t the petitioner was inducted as a Director in the said company o n 9.1 . 2018 and resigned on 9.5.2018, whereas the transfer of propert y too k place on 14.11.2018, when i n fact the petitioner never was a Director of the said company.

Meanwhile, in the event of a r rest, the petitioner be released o n int e rim bail subject to his furnishing p ersonal bonds and surety bonds t o the satisfaction of Arresting/Inve s tigating Officer. However, th e pet i tioner shall join the investigation as and when called upon to do s o an d cooperate with the Investigating O fficer and shall also abide by th e co n ditions as provided under Section 4 38 (2) Cr.P.C.”

Today, le a rned State counsel has filed s h ort reply by way of affidavit o f Mr. Moh i t Kumar, DSP, Sub Division K harar-2, SAS Nagar, which i s taken on record. Learned State counsel upon instructions has informe d that purs u ant to interim directions issued by this Court, the petitioner ha s since jo i ned investigation and is not required for any custodia l interroga t ion.

Having r e gard to the aforestated position , wherein the petitioner is state d to have joined investigation and is n ot required for any custodia l interroga t ion, the petition is accepted an d the interim directions issued b y this Cour t vide order dated 19.07.2024 a r e hereby made absolute subjec t to the co n dition that the petitioner shall join investigation as and whe n called upon to do so and cooperate wit h the Investigating Officer an d shall als o abide by the conditions as p rovided under Section 438 (2 ) Cr.P.C.
