sha r p edge weapons, pistols etc. It is all e ged that on 29.10.2023, Ajay Kuma r @ K amal, Jagtar Singh @ Jagga and Manjit Singh @ Nonna had snatched a wh i te coloured swift dzire car from som e driver. The information was furthe r to t h e effect that even on the given day, the aforesaid Ajay Kumar @ Kamal , Jag t ar Singh @ Jagga, Manjit Singh @ Nonna, Chanpreet Singh @ Kal u Bh a tra and Simaranjit Singh were trav e lling in the snatched swift dzire ca r after affixing a forged number plate and w ere hatching a conspiracy to commi t dac o ity at some residential house towa r ds Ishar Nagar side. It is further th e cas e of the prosecution that pursuant to r eceipt of said information, a raid wa s conducted and four persons namely Aj a y Kumar @ Kamal, Jagtar Singh @ Jag g a, Manjit Singh @ Nonna and Sima r anjit Singh were apprehended by th e pol i ce. However, the petitioner is not s tated to be anywhere near the plac e fro m where the aforesaid persons were a p prehended. Le a rned counsel further submitted t h at the petitioner has falsely bee n im p licated in the present case and that t h e falsity would be substantiated fro m the fact that despite the alleged secret in f ormation, it is only four persons wh o we r e found at the spot. It has further b e en submitted that as a matter of fac t the petitioner on the day of occurrence w as in Nanded (Maharashtra) and ha d tra v elled by train. Learned counsel in t h is regard has drawn the attention o f this Court to the railway ticket (Annex u re P-2), which shows reservation i n the name of Chanpreet Singh and other m embers of his family with respect t o the said journey on 22.10.2023. Le a rned counsel for the petitioner furth e r drawn the attention of this Court t o a c o uple of photographs stated to have b een taken with the help of mobile o f the petitioner, wherein date of taking the said photographs has also bee n me n tioned as 26.10.2023. It has bee n submitted that the factum of th e pet i tioner’s presence in Nanded (Mahar a shtra) can also be got verified fro m the call details record/tower location r ecord in respect of mobile of th e pet i tioner.
