1 . Challenge in the present regular second appeal is to the concurrent findings of fact returned by the Courts below in favour of the plaintiff-respondent in a suit filed by the plaintiff-respondent for declaration.
2 . The trial Court vide judgment and decree dated 04.12.2008 had directed the defendant-appellants to consider the case of the plaintiff-respondent to appoint her son on compassionate basis as per the instructions of the Government, on account of death of her husband, who was working as Constable in Haryana Police.
3 . Learned counsel for the respondent submits that in compliance to the aforesaid, about a decade ago, her son Suresh Kumar had been appointed as ClassIV employee (Water carrier) vide order dated 01.01.2013 as there was no stay granted in the regular second appeal and has since been continuing in service, which fact is affirmed by learned State counsel who submits that the appeal may be disposed of as such.
4 . Ordered accordingly.
