1 . The challenge in the appeal is by the defendant-appellant to the concurrent finding of fact recorded in a civil suit filed for possession by way of pre-emption.
2 . None had appeared on behalf of appellants on 04.02.2020, 17.04.2023 and 17.10.2023.
3 . As per office report, notice issued to the sole appellant received back with the report that he has expired. There is no representation on his behalf.
4 . Dismissed for non-prosecution.
5 . Registry is directed to send a copy of this order to the appellant at the last known address, as also to the concerned SHO of the area to intimate the same.
6 . A period of three months is granted for seeking recalling of this order.
